Applying for a US I-192 Entry Waiver

This guide explains how Canadians with a criminal record or past immigration issues can apply for a US entry waiver (Form I-192) to visit the United States temporarily.

What is Form I-192?

Form I-192, also called an “Application for Advanced Permission to Enter As Nonimmigrant,” allows Canadians to seek permission to enter the US despite reasons that might otherwise make them inadmissible.

Why Use a Lawyer?

Completing the I-192 application can be complex. A US immigration lawyer specializing in waivers can:

  • Prepare your entire application, including a persuasive explanation for why you should be admitted.
  • Ensure all documents are properly completed and strengthen your case.
  • Help obtain supporting documents.
  • Guide you through the process, including fingerprinting services and port of entry selection.
  • Reduce processing time by submitting electronically through e-SAFE (lawyers only).

What Information Do I Need to Provide?

The I-192 application asks for detailed information about:

  • Yourself (name, date of birth, address, etc.)
  • Your travel plans (purpose, entry point, duration)
  • Reasons for potential inadmissibility (past crimes, immigration violations)
  • Past immigration applications and US Aufenthalte (stays)

What Documents Do I Need?

  • Proof of citizenship and identity (passport, birth certificate, etc.)
  • Completed Form G-325A (biographical information)
  • Evidence of legal name changes (marriage certificates, etc.)
  • Recent official police record (RCMP)
  • Official records of any convictions
  • Court dispositions and documents related to sentencing or rehabilitation
  • (Optional, but recommended) Documents demonstrating positive changes since any offenses (character references, community service proof, etc.)

How Much Does it Cost?

The government filing fee is $585 USD, payable by check or money order drawn on a US bank and made payable to “U.S. Department of Homeland Security.” A USA Unlocked can help you navigate this payment. There will also be an additional payment to USA Unlocked dependent upon the complexity of your case. Book a consultation to learn more.

Where Do I File?

Applications can be filed with US Customs and Border Protection (CBP) at a designated port of entry or preclearance office. Fingerprints can often be done there as well.

Does a Pardon Help?

A Canadian pardon won’t erase your US record. You’ll still need a US waiver (I-192) to enter the US.

Can a Waiver Overcome Lack of Ties to Canada?

Typically, the I-192 form isn’t needed if you’re denied entry solely due to weak ties to Canada. You’ll just need stronger documentation proving a temporary visit.

What Crimes Does a Waiver Cover?

The I-192 can help overcome inadmissibility due to various crimes, including:

  • Drug possession
  • Assault
  • Theft
  • Drug sales
  • Fraud

Important Note:

US immigration waiver fees may increase in 2024 or 2025.
